The eight months of the Holiday Theatre

The Holiday at 2116 NE 162nd Street in North Miami Beach opened on 25 November 1970 with Patton. It was a dollar house and an immediate hit with the area’s older residents, which is worth holding on to, because of what happened next.

In April 1987 the screen switched to adult films at six dollars a ticket. The building carried a zoning restriction, sixteen years old by then, that it was never to show X-rated films. In June North Miami Beach’s code enforcement board found the theatre in violation and set a fine of $250 a day, running from 10 June.

The operating company appealed, arguing that its films carried no rating at all, so they could not be X-rated. A court refused to stop the fine in July, and the appeal was dropped on 3 December. On 11 December 1987 the inspectors found the Holiday closed. The fines came to $45,750, against the operator and the landlord, and management said it would be back with 99-cent films within a month or two.

It did come back, and it did not last. The Holiday closed for good on 5 July 1990 at the end of its twenty-year lease, with The Hunt for Red October and Miami Blues on the bill.

Seized at the Strand, 1970 to 1972

The City of Miami’s own story is a seizure. On 11 July 1970 three films were taken on a search warrant at the Strand Art Theatre under the city’s obscenity ordinance, Ordinance No. 7820. The company that ran it sued to stop the prosecution, and the circuit court upheld the ordinance by reading the U.S. Supreme Court’s Roth standards into it, but held that the city had to apply those standards before seizing anything. It stopped the municipal hearing set for 24 July 1970 and had the films returned.

Then, on the city’s motion, the same court ruled on the films without watching them. On affidavits and a police sergeant’s testimony it found them “in fact obscene”, as the Third District Court of Appeal recorded on 15 February 1972, and barred the company from showing “Married Bachelors”, “Computer Game” or “The Fur Piece”.

Federal prosecutors went after a different film at the Strand, “Turned On Girl”, and the federal side sat through it. U.S. Commissioner Edward P. Swan watched it on 4 November 1970 before he found probable cause and issued the warrant. On 15 February 1972 the Third District limited the city’s ban on the three films to Dade County and otherwise affirmed, and on 30 May 1972 the Florida Supreme Court declined review.

Little River, NE 79th Street

Two of Little River’s adult cinemas stood on NE 79th Street. The Little Theatre at 184 NE 79th Street, open by 1950, became the Little Adult Theatre on 18 September 1970 and closed in 1973. At 137 NE 79th Street the house became the 79th Street Art Theatre on 28 January 1961, and by the mid-1970s it had been twinned, with one screen for gay films. By one account it closed on 8 February 1984, at the end of a 30-year lease.
